ELLISON'S CAMPAIGN KEEPS NELSON-PALLMEYER'S CAMPAIGN UPDATED ON FEC FILINGS #2
I received a comment from Natalie Collins, who works for Ellison's campaign, about my post asking why Ellison's campaign emailed his Statement of Economic Interest to Nelson-Pallmeyer's campaign:
"The instructions for FEC Form 2, Statement of Candidacy, say 'The candidate must also simultaneously send a copy [of FEC Form 2] via facsimile machine or electronic mail to each opposing candidate. 11 CFR 400.20(b)(2).'
At the time Ellison filed, Jack Nelson-Pallmeyer and Martin Sabo were the only other candidates on file with the FEC. The FEC's help line recommended sending one to Martin Sabo even though he had announced his retirement.

Ms. Collins is confused.
A candidate for the House of Representative is required to send their Statement of Candidacy to a opposing candidates only with the plan to expend personal funds.
"Additionally, when filling out Line 9 (Declaration of Intent to Expend Personal Funds), thecandidate must send a copy of FECForm 2 or the information required therein to the Federal Election Commissionby facsimile machine (to 202-219-0174) or by electronic mail (to2022190174@fec.gov)."
Since Ellison typed 0.00 in lines 9A & 9B on his Statement of Candidacy, he doesn't have an intent to expend personal funds. Therefore, Ellison's campaign wasn't required to send his Statement of Candidacy to a opposing candidates.
I don't want to make a big deal out of this, but Ellison's campaign created a blog to respond to my inquiry.

Can't we all just agree that they were trying to abide by the law as they understood it. As such, they were not trying to "coordinate" with any other candidacy. And just move on?
Clearly there is nothing here to expose, and Ms. Nelson’s blog is kind of silly.
Just a questions, is she “staff” or is she a “volunteer” or affiliated with the campaign in some other way? Just wondering if this is an official response from the Ellison campaign, or just an over zealous campaign helper of some kind?

Ok...last comment, I promise. I just looked at that pdf from the FEC. I don't know a lot about this stuff, but it sure seems to me like it is easy to come to the conclusion the Ellison campaign came too:
House Candidates. Candidates seeking nomination or election to the U.S. House file with the Federal Election Commission, 999 E Street, NW, Washington, DC. 20463. Additionally, when filling out Line 9 (Declaration of Intent to Expend Personal Funds), the candidate must send a copy of FEC Form 2 or the information required therein to the Federal Election Commission by facsimile machine (to 202- 219-0174) or by electronic mail (to 2022190174@fec.gov). The candidate must also simultaneously send a copy via facsimile machine or electronic mail to each opposing candidate. 11 CFR 400.20(b)(2). Fax numbers and electronic mail addresses for opposing candidates are available from the FEC’s web site at www.fec.gov.
It doesn’t say “The candidate must also simultaneously send a copy via facsimile machine or electronic mail to each opposing candidate if the number on line whatever is more then $0.” It just says to send it. I am not sure I wouldn’t make the same mistake, if it is a mistake.

I agree with Trillin. There is no coordination here. They made a very simple error. I think we have all learned from the numerous Pawlenty campaign finance mistakes that it is always better to be on the safe side.
The only blunder here seems to be a naive campaign that felels it needs to "respond." That whole mess last week over delegate counts was simular. No professionaly run campaign should publicly engage in this crap. It just makes the campaign look amateur.
