First, the story started breaking when we learned from various sources that Tara McGuiness had been fired from the Klobuchar campaign for viewing a leaked Kennedy ad sent to her by a liberal blogger. We then proceeded to make it clear we were NOT the source of the leaked video. The Kennedy campaign held a press conference around 7:30pm, and the blogger who did leak the video, Noah Kunin of Blanked-Out, called a press conference shortly thereafter and came forward as the blogger responsible. At 10:16pm, the Star Tribune posted this piece which quotes Kennedy campaign manager Pat Shortridge underscoring the serious nature of the issue [emphasis is mine]: The leak of “very sensitive Kennedy campaign property” prompted immediate security checks of websites maintained by the campaign and its ad consultants, Scott Howell and Co. of Dallas, Shortridge said. [...]

I believe Howell has the ability to sue Mr. Noah directly as this is a civil matter.
Punitives from Kennedy also.
And if there is a pattern or a history of hacking into a private companiy’s information…and somehow just knowing what name or password to enter in also a matter that can be driven into the courts either by Howell or for influence peddling or id Noah sold it or did this while employed bya a group or org that would see benefits of this infor (used or not) t is procescutable.
It is theft of Intellectual Property.
So if the conduct is not prosecutable it is the theft of the IP that is very damming for Noah as I see it.

Amy would know that. For her to NOT relinquish the information to Mr. Kennedy IMMEDIATELY is also a crime.
She wiothheld that information and she is an officer of the court.

Bad move on her part for sure!

I am sure glad the FBI has this whole homeland security thing wrapped up so that they can dedicate time to tracking the internet habits of some kid in Minnesota.

Despite all the republican bluster, I have yet to identify any law that was bent, let alone broken.

It’s poor practice, but if you put something on your website in “…/folder158/sept2006/steve05/radioad5.mp3″ where there’s also a blind “index.html” in the same folder, you don’t expect people to find it right away. If they find it right away, then they had some help.

And it’s those tight connections that allowed him to find an ad using a web search.

Noah shouldn’t have turned this over to Klobuchar–they can’t accept it legally, and they did exactly the right thing here. But if he’s telling the truth, what kind of idiots are running the show at Camp Kennedy? What kind of nincompoops don’t password-protect future ads?
