First, Hardaway made his remarks this month and admitted in the interview that he was homophobic while Al made a joke 30 years ago. (And stop me here if you think there isn't anyone else in the world that made comments in 1976 that they wouldn't make today about the gay population.) Any any reference to Franken's comment should also reference the first and last paragraphs of the article where the author notes he is not sure if Al is joking. There is no analogy here.
