STAR TRIBUNE: “TED MONDALE IS ARRESTED FOR DWI: ‘I’M GUILTY’”

"Ted Mondale, onetime DFL gubernatorial candidate, former state senator and former chairman of the Metropolitan Council, was arrested and booked early Wednesday in the Hennepin County jail on suspicion of drunken driving.

Mondale, 49, said he went to the Twins game Tuesday night and then to dinner with friends downtown, drinking a couple of beers at the game and wine with his meal.

'I'm guilty,' he said. 'Whatever the punishment, I'm going to obviously accept it and never do that again.'" Source: Star Tribune, May 8, 2007

    The article stated that on advise of his lawyer, he refused the breath test. It’s potentially illegal for an attorney to give this advice (see Minnesota Statute 169A.78)

    I find it funny that two weeks ago Ted Mondale, a surrogate for the Edwards campaign, offered everyone at the MYDFL Convention to come to his house and drink beer. Even the high school students. I hope you find some video or something.

    Who is mondale’s lawyer?? The guy told him to refuse the test making it an automatic gross misdemeanor refusal with a one year license revocation as opposed to a misdemeanor and 90 day revo. Mondale, you’re a lawyer- how could you be that dumb??

    A “few” beers over nine innings and a glass of wine with dinner does not result in a DWI. His admission is admirable but the minimization takes any humilty out of the picture. In a sense he says he is guilty of breaking the law but makes no comment about being wrong, or the magnitude of driving intoxicated.

    It will be interesting to see if he gets the same treatment in court as John Q. Public would. The automatic revo for refusing may well get softened by the judge. Watch and see.

    On a brighter note, Ted is toward the top of the list of democrats that I personally respect. Mind you I disagree with most of his liberal ideology but he’s an approachable fellow with constructive ideas on how to improve Minnesota. Frankly, I wish we had more dems like him as opposed to Larry, Margaret and Tony.

    I think it just illustrates how easy it is to be considered “impaired”. I applaud him for owning up to it. If he has a problem, I hope he gets help… But I’d hate to see 100 posts on Ted Mondale’s DWI on MDE this week.

    Don’t overreact.

    Drew,
    He didn’t say he had “a glass of wine”; according to the Strib article he said he had wine with dinner which could mean several glasses. I haven’t been to a Twins game lately; do they still have beer available in those plastic dome cups that are like the size of a bucket? Two of those would impair someone.

    The point is people from both parties get DWIs, it shows poor judgement, but it’s not particularly shocking. But alas, to MDE everything is “breaking news” and “shocking!”

    Makes you kind of feel sorry for the fellow.

    A test refusal is a crime. His attorney advised him to break the law. Swell.

    Let me say it one more time: Wishing something bad to happen to another human being.

    And where is the hypocrisy? Let’s see Ted is a Minnesotan, he’s a democrat, and the news of his dui is therefore, exposed. Minnesota Democrats Exposed. What’s the problem?

    The libs wet themselves when I got arrested on a warrant for an unsigned federal migratory waterfowl stamp. I owned it. Big deal.

    There’s nothing quite as dehumanizing as getting processed into Hennepin County Jail.

    I used to work with a chronic drunk driver who had a very good (and dishones) lawyer. He’d get him off then would sue the police for something. He said his lawyer could get him out of any drunk driving arrest as long as he didn’t take the breath test.

    A few points.

    1. He got a DWI. He is no different than 30,000 other Minnesotans every year. It happens. Is it wrong, but he is not a bad guy because of this. Geez. 1 in 7 Minnesotans have one. He made a mistake in judgment. It happens to a lot of decent people every week. Soon you won’t be able to have a drink at all.

    2. Give him credit for admitting he screwed up.

    3. His lawyer is an idiot. He got terrible legal advice. Mondale ought to sue him for malpractice. As leftfieldbleacherguy pointed out, he was facing a 30 day license revocation and a misdemeanor, but by refusing the test, he turned it into a gross misdemeanor and a 1 YEAR license revocation. This lawyer is an idiot.

    4. And it is it pleaded down to a misdemeanor, don’t everyone have a fit. That is common on 1st time DWI’s.

    boy lots of comments on how “bad” a dwi is on here. Lots of judgmental folks. It is not like he killed someone. And those who dragged Bush and Cheney and Kennedy in it. Give it up. It’s a DWI, a misdemeanor crime. It happens. People make mistakes.

    If he thought he might be over .20 BAC then it was wise to refuse since it counts as if it were 2 DWI’s then and its a Gross Misdemeanor 6 months revocation and mandatory minuimum of 30 days in jail, then if you ever get arrested again you would be on your third one then also instead of your second one.
