Actually, this never was much of an issue. The Supreme Court can accept or reject amicus briefs at their discretion. And neither acceptance nor rejection should be taken as a reflection on the lawyers, or their arguments. Emmer is a bright guy and a good lawyer, and in this case, I am sure the Court would benefit from hearing his views.
