BREAKING: DAYTON ORDERS ILLEGAL UNIONIZATION VOTE BY PRIVATE DAYCARE PROVIDERS, SENATORS WILL FILE INJUNCTION TO STOP IT

By Andy Post | November 15, 2011

The AP is reporting that Gov. Dayton this morning announced he would order a vote on home childcare providers to unionize:

Gov. Mark Dayton has ordered a vote among home-based child care providers about whether they should unionize.

His executive order issued Tuesday sets an election for December. It affects thousands of self-employed providers.

The state Bureau of Mediation Services will oversee the election. Dayton says if a union is authorized during the vote, membership would be voluntary.

Dayton’s decision furthers an already politically charged debate over union rights. The Democratic governor and majority Republican lawmakers have clashed for months about Dayton’s authority to call an election and whether a union should exist.

Here’s the release from Dayton’s office.

According to several sources in the Minnesota Senate, Senator Perry and others may file an injunction to stop the executive order on the grounds that the providers are private, independent contractors. KSTP reported on Perry’s intentions:

The Waseca Republican says he will consider legal action, if the Governor does sign the executive order paving the way for a statewide vote. Union officials say organized daycare workers would have more bargaining power to negotiate state subsidy payments and they would have the right to appeal any regulatory action taken against a home daycare provider.

Dayton is orders a vote? well, who is voting?

Voters, Unions or just day care people? Where are the controls?

I can’t see how this can be legal. It’s not a company they are independent contractors, right?

Tomorrow he plans to issue similar orders for a January vote for Babysitters, followed by a vote in March to unionize kids who mow lawns. Late today a group of lemonade stand owners begged Dayton to not order a vote to unionize them.

They’re self-employed, sole proprieters. If they want to join a group, they can join an association.

This “union” effort is the most confounded, stupid fucking thing I’ve seen. And Dayton’s eagerness to lend it legitimacy says volumes.

The guy is a drooling retard.

81% of total daycares operators are agaisnt it…

So to get aroudn this Dayton is only allowing the “minority” day cares vote, something to do with the ones that get state money.

But this will affects all day cares.

Glad my kids are in HS. We barely broke even with working and day care costs 15 years ago.

Sounds like this will be challenged in the courts.

    More to come.

Of the state’s 11,000 licensed child care workers, only 4,300 are registered to accept children whose families receive child care subsidies. That means the election will be open to fewer than half the child care workers in the state.

This “WILL NOT AFFECT ANY CHILDCARE PROVIDERS TAHT DO NOT TAKE STATE SUBSIDIES BECAUSE THEY ARE OPERATING THEIR OWN BUSINESSES OUTSIDE THE REALM OF GOVERNMENT”

The governor said repeatedly on Tuesday that he takes no sides in the union fight but said he is “sympathetic” to those who are looking for “better wages, better working conditions, benefits like health care,” that unions can bring.

People this is a vote for people to have the choice to join a union. The government NOT allowing this is CHOICE is more of an intrusion to one’s life that government allowing the choice. Please think for yourself, use independent thought before towing Republican/Democrat lines.

Why the heck are we subsidizing day care?
